Merril Hirsh is the complete package. His deep and broad experience as a counselor and litigator, in advocating on behalf of clients and understanding their interests, complements his innate talent as an effective neutral. Add to all of that a superlative work ethic, creativity, and a passion for “getting to ‘yes.’” A lawyer and her or his client will be in excellent hands with Merril as the neutral.
– William D. Johnston, partner at Young Conaway Stargatt & Taylor, LLP in Wilmington, Delaware and Immediate Past Chair of the ABA Business Law Section
Merril Hirsh is an organized and experienced litigator who gets things done! He has been chairing a special ABA Committee relating to Special Master appointments. I have worked with him on this project for the past 18 months. He is efficient and effective. He encourages others to work with him and with each other. These traits would make him an outstanding mediator, arbitrator or special master.
— Hon. Shira A. Scheindlin, United States District Court for the Southern District of New York (ret.)
Over the past 20 years, Merril Hirsh has represented OncoImmunin, Inc., a small Maryland biotechnology company, in a series of cases, each of which had the potential for extensive and costly litigation. However, due to Mr. Hirsh’s command of the law as well as his quick understanding of scientific issues in dispute, resolution was achieved in each case with minimal disruption of our company’s business operations. Additionally, he has provided representation in matters concerning the quality of care in an assisted living facility. His experience with and understanding of the litigation process provides a superb background for extremely efficient management of resolutions covering a wide range of issues.
– Beverly Packard, Ph.D., President OncoImmunin, Inc.
While a senior Claim Officer at Chubb, I worked with Merril for over twenty years on many of the most complex and highest-value matters. His insight and analysis of the issues was always clear, well-balanced and thoughtful. He brought to his work the experience of a litigator and the skills of someone adept at developing and executing effective resolution strategies. In fact, each such claim resolved successfully through litigation (including trial), mediation or settlement discussions. I would highly recommend Merril to anyone seeking excellent services in any of his many areas of expertise.
– Kim Hogrefe, principal Kim Dean Hogrefe, LLC (former Senior Vice President of Chubb serving as the Worldwide Specialty Claim Manager and Worldwide Claim Technical Officer)
I practiced law with Merril for more than 20 years. Among other things, he taught me how to take my very first deposition as a newly-minted attorney, and we worked together on complex litigation matters, from insurance coverage to patent and trademark disputes. Merril is one of the smartest people I know. He has an uncanny ability to identify all the nuances and angles of even the most complex matters, analyze them thoroughly, and explain them persuasively. Merril is someone who could pick up pretty much any case in any subject matter and figure it out very quickly.

I have known Merril for the past decade as a friend, but it began much earlier in a professional capacity when I hired Merril and his firm to litigate a highly controversial agency rulemaking on behalf of our trade association. Most observers considered us to be in the proverbial David versus Goliath role vying against a powerful federal agency. The resulting surprise decision in our favor, after nearly two years of litigation, led to the U.S. Court of Appeals for the District of Columbia Circuit vacating the rule in its entirety. While Merril successfully managed our case from beginning to end, and correctly identified the weak points in the rulemaking, I was equally impressed afterward when he reached out to the prime architect of the rule during an industry conference. I also know that person well, and how proud he was of the rule that Merril was instrumental in dismembering. While litigators are born with competitive DNA, my experience working directly with Merril suggests to me he has another kind of DNA, one that allows him to rise above the fray and objectively surveil not only the legal environment, but also the emotional currents that often produce unproductive results and additional legal costs. I strongly commend Merril as someone who will serve an invaluable, impartial role analyzing the facts and helping both parties reach a middle ground with integrity and fairness.
— Duane Thompson, AIFA, Principal of Potomac Strategies, LLC (former Managing Director DC Office, Financial Planning Association)
Merril Hirsh worked with DC Appleseed pro bono on a project designed to make DC’s Attorney General more accountable to the public and make it an elected office. The project required careful analysis of a number of competing claims as well as the bringing together of a number of conflicting viewpoints. Merril was superb at both those undertakings and helped lead us to a really good outcome for the residents of DC.
— Walter Smith, Executive Director DC Appleseed
Merril Hirsh’s many years of experience litigating some of the largest and most complex cases on behalf of the United States of America and for private entities stand him in good stead to evaluate, advise on, and resolve the thorniest and most intractable issues. Merril has litigated successfully against some of the most formidable opponents, bringing cases to a positive resolution for his clients. His legal skills and creativity have garnered positive recognition by all who encounter him. — Elizabeth Sarah (“Sally”) Gere, Former Deputy Attorney General of the District of Columbia
I’ve worked with Merril for more than 20 years. He brings a unique and valued perspective to dispute resolution. His wealth of complex litigation experience, detailed knowledge of the insurance industry, and longstanding relationships with plaintiffs’ counsel, defense counsel and insurance executives will greatly facilitate the resolution complex disputes in a fair and reasonable manner. You can be confident that your position will be evaluated carefully, thoroughly and with integrity, and if there is a way to settle on good terms, Merril will almost certainly find it.
